Terms of Service & Carriage
Effective Date: October 2026 • Olooi Inc. • Ontario & Federal Canada
1. Logistics Consignment Agreement
By booking or tendering a consignment through Olooi Inc. ("Shipora"), whether via the web booking wizard, business portal, bulk CSV ingestion, or dispatch phone liaison, the shipper agrees to these terms governing pickup, line-haul carriage, sorting milestones, and certified delivery handover.
2. Cargo Liability & Default Warranty Coverage
All standard commercial consignments include default carrier warranty protection up to $100.00 CAD against physical loss, theft, or catastrophic transit damage while under direct carrier care and custody. Optional declared value insurance coverage can be purchased at the time of booking.
Shipora shall not be held liable for indirect, incidental, or consequential losses, including lost business profits, delays arising from severe Ontario weather emergencies, or government border/highway closures.
3. Tariffs, Fuel Indexing & Integer Minor-Unit Math
All rates are quoted in Canadian Dollars (CAD) and calculated using verified integer minor units (cents) to avoid floating-point rounding errors. Distance charges are computed via actual highway kilometers between geocoded postal codes. Fuel surcharges are indexed to the monthly Ontario average diesel fuel benchmark, and statutory Ontario Harmonized Sales Tax (HST 13%) is assessed on all applicable line items.
4. Prohibited Articles & Dangerous Goods Compliance
The shipper warrants that no package contains illegal contraband, hazardous explosives, unauthorized firearms, corrosive industrial chemicals, or items restricted under Transport Canada Transportation of Dangerous Goods (TDG) regulations, unless explicitly declared under specialized hazardous material courier handling.
5. Certified Electronic Proof of Delivery
Delivery is deemed complete upon the collection of a digital signature, confirmed recipient name, and optical confirmation by the assigned driver. The resulting electronic Proof of Delivery (POD) waybill constitutes definitive legal evidence of safe cargo handover.
6. Governing Jurisdiction
These Conditions of Carriage shall be governed by, construed, and enforced in accordance with the substantive laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal dispute shall be subject to the exclusive jurisdiction of the courts of Ontario.
